NEW YORK, Aug. 15, 2013 — A Pfizer pharmaceutical maker on Monday said it has agreed to pay $3.2 billion to settle an antitrust complaint involving it selling counterfeit Lipitor and Pfizer Inc.'s (NYSE: PFE) drug Lipitor XR, the world's second-largest drug maker, to settle a lawsuit alleging the drug maker was hiding anticompetitive practices in a deal between Pfizer and AstraZeneca to settle antitrust lawsuits over alleged marketing practices.
Pfizer has been accused of making millions of dollars selling fake Lipitor and Pfizer products. The company, which sells its anti-psychotic drug Celebrex, has long been accused of price-fixing its products and selling them on the black market.
The lawsuit, filed in federal court in Brooklyn, New York, says Pfizer agreed to settle the lawsuit, which alleges Pfizer paid $6.5 million to resolve a class-action lawsuit involving the alleged marketing practices, a level of liability that AstraZeneca asserted in the settlement. Pfizer paid $2.5 million to resolve the lawsuit, which also alleges AstraZeneca paid $1.4 million to resolve allegations that the company's sales representatives were paid kickbacks to encourage salespeople to use prescription drugs for a condition that AstraZeneca denied.
The lawsuit alleged Pfizer, which has a history of promoting and selling products without a prescription, promoted Lipitor XR products by selling them to patients to treat a different condition.
The lawsuit also alleges Pfizer, in breach of contract and conspiracy, marketed and sold Lipitor XR products to people who had not yet been diagnosed with a psychiatric condition, and marketed and sold Lipitor XR products without a prescription.
The lawsuit also alleges that Pfizer promoted Lipitor XR through marketing, promotion and sales of its drugs to doctors for a condition known as anorexia nervosa.
In the lawsuit, Pfizer said it is not aware of any evidence the company or its executives knew about the potential risks of the drug, including possible increases in side effects and side effects of other drugs. The company also did not respond to a request for comment on Monday.
Pfizer shares fell 7 cents to $31.74 on the New York Stock Exchange. The pharmaceutical company reported earnings of $1.18 per share on market sales of $10.3 billion in the U. S. on Monday.
